Piracy can only occur in International Waters. There are no modern
laws that cover the problem. Dutch mariners are relying on 17th
century law, which makes it sound like that was the last time folks
had crap for brains.
Bottom line is... since there are no guidelines... you'll probably get
a pass for blowing the hell out of the aggressor...
There are rules for dealing with pirates that are relevant today and
written in the latter half of the 20th century.
These rules stipulate that only war ships, or others so identified, can
deal with pirates.
