Not if you could be safely towed after using your handheld to advise the

marina
that you were coming in under sail.

There isn't one. My club has no rules against sailing into a slip. But if yours
does then you should follow procedure. Radio in via handheld BEFORE sailing in.

So does stupidity make it absolutely necessary in which case you are free to sail into the marina ALL the time

Yes, and it's your call as skipper as to what is "absolutely necessary."
It's easier to ask forgiveness than to seek permission.
