Took the Chevy Blazer and the flatbed trailer 4X8 to the post office
today. No place to park so I stuck it in a spot and the trailer was
hanging out in the lane and ran inside the post office. A guy in a new
truck backs out af an adjacent spot and hits my trailer, now he want
to sue me for damage to his truck. Am I liable or is he responsible?
Any Ideas?
Scotty
In a parking lot??
Believe I heard around here it's 50/50 split.
Where I come from, you hit a stationary object while you are driving, your
fault.

When the guy fell asleep in the rental car and hit my parked truck in the
parking lot, was 100% his fault. What was amazing, was the body shop's
estimate was about what my truck was worth. Bent the bumper and the fender
mount so the tailgate was misaligned to the fender. $2200.- Hide quoted text -

Holy frekin ****!!! I just remembered where I met this guy before..
It
was about two months ago, he actually bumped the back of my wifes car
at a stop light. The bitch of the whole thing is I had a tiny scratch
but told him to go ahead and forget about it.. I gave the guy a
break.
He said he didn't see my brake lights that time, apparently the guy
doesn't watch where he is going.. If you saw him you would know. He
has a custom plate, the obligatory tuff guy stickers on his rear
window, a huge washed up wananna be jock.. Just can't beleive he is
driving around like that, wonder how many others have given him a
break. This guy is the stereotypical ashole.. man, can't believe I
let
him off and now he is trying to screw me.... I am sooooo ****ed...

You might have bumped into krousie and nor realized it.

If you had balls and a stepstool to stand on, you could say that to my
face. But since you have neither, you're really just an ignorant,
hot-tempered little ****, and therefore someone at whom to poke fun.

Poke...

From what I hear, you won't even answer your door lately.. you should
talk.

I don't know if it matters, but this was on private property, in a
parking lot so no tickets were issued... This guy says he is going to
call his ins agent, should I call mine and make a claim for the
scratch on my trailer just to cover my ass?
----------------------------------------------

Here's my free advice, for what's it's worth:

1. *Private property or not, a accident report should be filed with
the police, especially if he is
* *making noises about suing, or holding you responsible. * You can
still do that.

Yep.

2. I'll bet if you check your insurance policy, you are *required*
to report to them any accident in
* *which a claim may be made.

I'd make this PRIORITY ONE.

3. *Do both. *Write down your recollection of what happened and make
copies. If insurance adjusters
* * start calling or asking for a statement, hand a copy of the
same, written statement to them and
* * any other authorized authority that asked for a statement.

Indeed. Pictures, paragraphs, etc. .... a preponderance of evidence is
what is likely to carry the day....

4. *States vary with their insurance regulations. *Check yours..

Yep.

Hey, when I posted this, your server added a sig file.. or so it would
seem, Test..

Just an update.. Geico got a good chuckle out of this. They are going to
call this guy and tell him to get lost and learn to drive...

Rowdy Mouse Racing, "Not Guilty!"

Unless he is a customer of theirs and he has notified them or he has
filed a claim against you already, it is unlikely GEICO is going to call
him.

Guess, you will never know. They said they are going to contact him,
that's what the adjuster said...- Hide quoted text -

Little follow up.. The guy called me this morning and asked me to pay
$138 for the buff and blend. I called Geico, and a nice lady named
Nicole took his number and I probably talking to him right now. She
said no matter where or how I was parked, legally or illegally, she is
going to tell him it is his fault and that if he wants to get paid he
will have to go through his insurance company.. period...

Gotta' love the little green Lizard...
