They are considered a "sidearm" and subject to the same mandatory 5 year sentence as a firearm... |

I used a baseball bat to remove him, not a gun. Turns out he was a escaped patient from a home down the street, and didn't know where he was... If Harry had had the same, a innocent person would be dead instead of just having a broken rib... We're smart enough down here to tell the difference between a little **** intent on violence (like you) and someone suffering from a non-violent mental disorder. I suppose we really don't know if this guy had violence on his mind. He was taken out before he could do what he came there for. It would be interesting to track him down and see what he is doing now. If he turns out to have killed someone later, was not shooting him better for society? Breaking into a strangers house at 0130 is not an indication of a person with good things on his mind. As a purely legal thing, shooting someone and hitting them with a bat is pretty much the same thing. My assumption is that anyone breaking into the house has criminal intent. I'm not a spy or a drug dealer or a terrorist, so if the police come calling, it'll be during the day, they'll knock on the door and have proper credentials. At 1:30 am, whoever is breaking in pretty much deserves what he gets. The only flaw in that theory is the number of times SWAT teams do break into the wrong house or are just operating on bad information. Remember the guy in Northern Va. He confronted a bunch of cops on a bad raid with a muzzle loader and they had semi autos. (Ballou? maybe James Ballou?) one can only hope when it happens to harry, no cops get killed before they blow his ass away... |

As soon as you threaten someone with it, a bat becomes a weapon, just like a gun. The strange thing is, I have a permit to carry a gun, even my machine gun but I can't carry a switchblade knife or brass knuckles. ... and if you take that bat and cut about 7 inches out of the middle and replace it with chain or rope, you can't carry it either ![]() |

Since you did not lock your door, you (and your family) most likely had a "duty to retreat." That depends on where you live. The obligation of retreat is mostly a north eastern and left coast, blue state thing. In Florida, all you need is a fear of bodily harm and you have the right to use force. These days that is extended from the home to "anywhere you have a legal right to be" with the "stand your ground" law. In your home, RV or boat, the mere fact that someone is there is usually enough evidence that you can infer the intent of bodily harm. In most cases I have watched here locally they extend that to your yard. (guys shooting unarmed auto burglars) The state's attorneys have been very reluctant to bring cases against these people after a few were tossed on "stand your ground". I would have probably said about the same thing, but I have no need to explain myself to another Harry sockpuppet... |
