It's concievable that it might be something as simple as not knowing
how to turn on the AIS transponder.

It is a rather harsh assessment of multiple failures, some of which
are incredibly basic:

- They were at an unsafe speed for the location and traffic density

- The AIS system was not utilized (apparently for both receive and
transmit)

- There were no lookouts on the starboard side

- The RADAR was improperly tuned

- They did not realize that they were in a traffic separation zone

- There was no attempt to contact or warn nearby vessels

- The commanding officer was not notified of impending risks

- They attempted to cross ahead of a vessel in a traffic separation
zone

- The crew had poor knowledge of the International Rules of the Road
